Terms of Service
Last updated: 1 November 2026
1. Provider and scope
Services are provided by LUCA PILIPOV, obrt za usluge, vl. Luka Pilipović, Paška 3, 52440 Poreč, Hrvatska, OIB 37131560865 (Provider), owned by Luka Pilipović. The business is outside the VAT system. Contact: lukapilipovic25@gmail.com, +385 99 461 06 81.
These terms cover DJ, MC and related agreed services for the person or business booking them (Client). They are supplied or clearly referenced before the contract is concluded. Accepting an offer, signing a contract or paying the agreed advance accepts these terms only if they were previously available to the Client. Individually agreed provisions take precedence, but cannot exclude mandatory legal rights.
2. Offers and date reservations
The website form sends a non-binding enquiry, not a purchase or automatic booking. Verbal discussions and enquiries do not hold a date.
A date is confirmed once the requirements of the written offer or contract are met: payment of the agreed advance and/or signature. The offer specifies the date, venue, duration, equipment, included services, total price and any additional costs. Changes and extra hours require written agreement, availability and prior approval of the price.
3. Prices and payment
The advance amount, balance deadline and payment method are set out in the offer or contract. Payment is made to the business account or by another expressly agreed lawful method, with an invoice issued. This website does not require online payment.
An advance is credited towards the total price; it is not automatically earnest money or a penalty. Travel, accommodation and other extras are charged only if clearly disclosed and accepted beforehand. Late payment is handled under the contract and law, with prior notice to the Client.
4. Cancellation and date changes
Cancellations and date-change requests must be sent in writing. A new date is subject to availability and written agreement. Cancellation consequences should be clearly stated in the offer before booking.
If the Client cancels for their own reasons, the Provider may claim only a lawful, previously agreed and proportionate charge for the reserved date and justified loss, taking saved costs and the possibility of rebooking into account. The advance is not automatically retained in full; amounts exceeding a justified claim are refunded. Mandatory consumer rights remain unaffected.
If the Provider cannot deliver the service, the Client will be notified without delay and payments for undelivered services refunded. A suitable professional DJ may be proposed, but any replacement requires the Client's agreement. Other rights and liability are determined by applicable law.
5. Consumers and distance contracts
A consumer is an individual booking outside their business activity. Before a distance contract is concluded, they receive the legally required information and confirmation on a durable medium, such as email.
A statutory exception to the 14-day withdrawal right may apply to leisure-related services on a specific date or period. Where it applies to the particular event, the Client will be expressly informed before contracting. Otherwise, statutory withdrawal rights, required information and the withdrawal form apply; publishing these terms alone does not remove that right.
6. Venue requirements
The Client, together with the venue, arranges safe, stable 230 V power, grounded sockets near the DJ position, a level dry surface and safe access for delivery, setup and removal at agreed times.
Outdoor events need appropriate shelter from rain, wind and strong sun. Technical requirements are confirmed beforehand. Permits, noise limits, programme end times and venue obligations are coordinated in advance.
7. Safety and equipment damage
The Client and venue cooperate to protect guests, the Provider and equipment. Drinks and other hazardous items must not be placed on equipment. The Provider may pause a performance in a genuine unsafe situation and, if safety cannot be restored, stop it after notifying the organiser.
Damage liability depends on cause, fault and applicable law. The Client is not automatically liable for every guest's actions; intentional damage is documented and claimed from the responsible person, or from the Client only where a lawful basis exists. Stopping the performance does not automatically forfeit all payments.
8. Music and copyright
The Provider performs as an open-format DJ, adapting the selection to the atmosphere and agreed concept. The Client's key songs and restrictions are discussed beforehand. Guest requests that conflict with the concept or disrupt the event may be declined.
Responsibility for public-performance licences and fees, where required, is agreed with the organiser and venue under applicable law; these terms do not transfer statutory obligations away from the legally responsible person. Website materials must not be copied or used without authorisation contrary to the rights of their owners.
9. Privacy and promotional recordings
Personal data is handled under the Privacy Policy. Accepting these terms is not consent to analytics or publication of images or recordings of identifiable people.
Promotional publication of identifiable people requires separate, voluntary, specific consent or another previously verified lawful basis; the Client cannot consent on behalf of all guests. Children require particular protection and appropriate permission from a legal guardian when relying on consent. Equipment and atmosphere footage may be used only if it genuinely reveals no identity, including through voices, and respects creators' rights and venue rules. Agreed confidentiality is respected.
10. Liability and force majeure
The parties notify each other without delay of unforeseeable, unavoidable circumstances preventing performance, such as extreme weather or an official prohibition, and seek a reasonable solution. Illness or equipment failure is not automatically force majeure; the particular circumstances must be assessed.
Where performance becomes impossible, services actually delivered are accounted for and payments for the undelivered part refunded in accordance with law. Nothing excludes liability that cannot legally be excluded, including intent, gross negligence and mandatory consumer rights.
11. Written complaints and disputes
Send written complaints to lukapilipovic25@gmail.com or by post to LUCA PILIPOV, obrt za usluge, Paška 3, 52440 Poreč, Hrvatska. We acknowledge receipt without delay and reply in writing within 15 days of receipt, stating clearly whether we accept the complaint as justified.
We first seek an amicable resolution. The Client may use available statutory procedures, competent consumer alternative-dispute-resolution bodies and the competent court. Croatian law applies without depriving consumers of mandatory protection or jurisdiction rights under applicable law, including those of their country in cross-border contracts.
12. Versions of these terms
The version made available and accepted when the contract was concluded applies to that booking. Later updates do not change existing bookings without agreement. All four language versions provide understandable information; no version limits statutory rights on language grounds.
